Quotely Pro Terms of Use

Last Updated: [Tuesday, 30 September 2025] These Pro Terms of Use (“Terms”) form a binding agreement between you (“Agent,” “Provider,” or“you”) and Quotely, Inc. (“Quotely,” “we,” “us,” or “our”) governing your participation in the Quotely Pro program and your purchase, receipt, or use of consumer leads (“Leads”).

By creating a Pro account, purchasing Leads, or otherwise using Quotely’s services, you agree to these Terms and our Privacy Policy.

1. Eligibility & Registration

  • You must be a licensed insurance agent, broker, or authorized representative in your state of operation.
  • You agree to provide accurate business, licensing, and contact information, and to keep it up to date.
  • Quotely may verify your credentials at any time.

2. Leads & Usage Rules

A “Lead” means consumer information provided by Quotely for the purpose of offering insurance quotes.

  • You agree to use Leads only for legitimate insurance marketing and sales activities.
  • You may not resell, share, or transfer Leads to third parties without Quotely’s written permission.
  • You must comply with all federal and state laws, including but not limited to:
  • TCPA (Telephone Consumer Protection Act)
  • CAN-SPAM (email marketing laws)
  • State insurance marketing regulations

3. Payment & Billing

  • Leads are sold at prices set by Quotely (or agreed to in writing).
  • You authorize Quotely to charge your payment method on file for all Leads delivered.
  • Unless otherwise stated, all sales are final. Lead returns or credits may be granted only at Quotely’s sole discretion.
  • You are responsible for taxes, fees, or charges arising from your Lead purchases.

4. No Guarantee of Results

  • Quotely does not guarantee that any Lead will convert into a sale, policy, or profit.
  • Lead quality may vary depending on consumer information and market conditions.
  • Your success depends on your own sales practices, compliance, and follow-up.

5. Intellectual Property & Branding

  • Quotely owns all rights to its website, apps, branding, software, and data systems.
  • You may not use the Quotely name, logo, or marks without written approval.

6. Termination

Quotely may suspend or terminate your Pro account at any time for:

  • Non-payment
  • Misuse of Leads
  • Non-compliance with laws or these Terms
  • Conduct harmful to Quotely’s reputation or consumers
  • You may terminate your account at any time, but outstanding balances remain due.

7. Disclaimer of Warranties

Quotely provides Leads “as is” and disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Dispute Resolution & Arbitration

  • Informal Resolution: Parties must first attempt resolution through a written Consultation Notice and 30-day period.
  • Arbitration: Unresolved disputes will be settled by binding arbitration under the Federal Arbitration Act.
  • Class Action Waiver: Claims must be brought individually, not as part of a class or collective action.

10. Governing Law

These Terms are governed by the laws of the State of [Insert State], without regard to conflicts of law.
